DOJ releases Jack Smith report on J6, claims Trump would have been convicted if not elected – Trump responds

Attorney General Merrick Garland released Volume One of Special Counsel Jack Smith’s report on his January 6 investigation into former President Donald Trump on Tuesday.

The release followed the expiration of a temporary injunction that had blocked publication until midnight on Monday.

Background on the January 6 Charges

In September 2023, Trump was indicted on four counts in connection with Smith’s January 6 case in Washington, D.C. These charges included:

  • Conspiracy to defraud the United States
  • Conspiracy to obstruct an official proceeding
  • Obstruction of and attempt to obstruct an official proceeding
  • Conspiracy against rights

The charges were part of a broader investigation into Trump’s alleged efforts to overturn the results of the 2020 presidential election.

However, Smith’s case suffered a major setback in June 2024 when the U.S. Supreme Court struck down the 18 U.S.C. § 1512(c)(2) obstruction charge central to the case. The ruling significantly weakened the legal foundation of Smith’s prosecution.

Smith’s Report and Claims

Despite the Supreme Court’s ruling, Smith remained adamant that Trump would have been convicted had the case gone to trial. In his report, Smith described Trump’s actions as egregious and harmful to the nation.

“Trump’s cases represented ones ‘in which the offense [was] the most flagrant, the public harm the greatest, and the proof the most certain,’” Smith wrote, according to Fox News.

The report also reiterated the Justice Department’s position that the Constitution bars the continued indictment and prosecution of a sitting president, regardless of the gravity of the alleged crimes.

Smith expressed frustration with the constraints that prevented the case from moving forward after Trump’s 2024 election victory.

Trump Responds to the Report

Former President Trump took to Truth Social to denounce Smith’s report as politically motivated and baseless.

“Deranged Jack Smith was unable to successfully prosecute the Political Opponent of his ‘boss,’ Crooked Joe Biden, so he ends up writing yet another ‘Report’ based on information that the Unselect Committee of Political Hacks and Thugs ILLEGALLY DESTROYED AND DELETED,” Trump posted. “It showed how totally innocent I was, and how completely guilty Nancy Pelosi, and others, were.”

In a follow-up post, Trump accused Smith of desperation, highlighting the timing of the report’s release. “To show you how desperate Deranged Jack Smith is, he released his Fake findings at 1:00 A.M. in the morning. Did he say that the Unselect Committee illegally destroyed and deleted all of the evidence?”

Political Implications

The release of Smith’s report adds fuel to an already contentious political landscape. Trump’s supporters view the investigation as a politically motivated effort to undermine his presidency and 2024 campaign.

Meanwhile, critics argue that the report underscores the seriousness of Trump’s alleged actions and the challenges of holding a former president accountable.

As Trump prepares to return to the White House, the fallout from Smith’s investigation and report is likely to remain a focal point in the ongoing debate over accountability, justice, and political partisanship in America.

Convicted? Convicted of dredged up charges, from beyond the Statute of Limitations, that should have been a misdemeanor! Magically, the Comrades in the Justice Department converted it into a felony!
I can’t wait to see the nation go back to a government comprised of AMERICANS!
